- You are responsible for all activity under your account. We are not liable for losses caused by unauthorized access resulting from your negligence.
2. Service Description and Use
- Our Service allows you to upload photos and generate AI-based headshots.
- You agree not to upload or use any content that is illegal, pornographic, violent, hateful, discriminatory, or infringing on third-party rights.
- You may not attempt to reverse engineer, interfere with, or misuse the Service or its APIs.
- We reserve the right to refuse or terminate access if your use violates these Terms or applicable law.
3. Intellectual Property
- All intellectual property related to our software, algorithms, user interface, text, and branding belongs to HeadshotPic or its licensors.
- Photos you upload remain your property. You grant us a limited, non-exclusive license to process, store, and display them solely to provide the Service.
- Generated headshots belong to you. You may use them for personal or commercial purposes, provided they do not violate others’ rights or applicable laws. Preview images are for non-commercial evaluation only; commercial use applies to plans that include commercial rights.
4. Payments and Refunds
- Certain features require payment. Prices and plan details are shown on our website and may change occasionally.
- All payments are securely processed by Paddle (our merchant of record). We do not store or process payment card information directly.
- Refunds:
- Full refunds are available if your paid order has not started processing.
- Partial refunds may apply if generation fails due to a technical issue.
- Once HD images (1024×1024) have been successfully generated or downloaded, refunds cannot be issued.
- Refund requests must be made within 7 days of purchase by contacting support@headshotpic.io.
5. Disclaimers and Limitation of Liability
- The Service is provided “as is” and “as available” without warranties of any kind.
- We do not guarantee uninterrupted operation, accuracy of generated images, or compatibility with all devices.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
- Our total liability for any claim shall not exceed the total amount you paid to us for the Service.
6. Termination
- We may suspend or terminate your account at any time if you violate these Terms, misuse the Service, or engage in harmful behavior.
- You may stop using the Service at any time. Upon termination, your account and uploaded data may be deleted in accordance with our Privacy Policy.
7. Privacy
Your privacy is important to us. Uploaded images are encrypted, used only to generate your results, and automatically deleted after 7 days. Please review our Privacy Policy to learn more.
8. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable laws of the United States and European Union. Any disputes shall first be resolved through good-faith negotiation. If unresolved, they shall be submitted to arbitration or a competent court in your jurisdiction.
